Job Loss & Your Home
Losing your job does not mean losing your house, and it does not mean you have to sell it this month. It does mean a clock has started, and your best options are the ones you use before the first missed payment.
This guide lays out what to do in the first week, how long Texas law really gives you, and how to tell a smart sale from a panic sale. If you are already behind and have an auction date, go straight to how to stop foreclosure in Texas.
Should you sell your house after a job loss in Texas? Not automatically. File for unemployment and call your mortgage servicer in the first week, then work out how many months your savings can carry the house. If that runway is shorter than a realistic job search and you have equity, selling while you are still current lets you leave with that equity instead of losing it to late fees and foreclosure costs.
You have time to decide properly: federal rules bar a servicer from starting foreclosure until a loan is more than 120 days delinquent.

The First Week: Three Calls Before Anything Else
None of these commits you to anything, and each one gets less useful the longer you wait.
1. Texas Workforce CommissionApply for unemployment the week you are let go. TWC dates a claim from the Sunday of the week you apply, so every week you wait is a week of benefits you do not get back. A layoff for lack of work generally qualifies. Being fired for misconduct or quitting usually does not.
2. Your mortgage servicerCall before you miss a payment, not after. Tell them what happened and ask which hardship options they offer. The CFPB’s advice is to let your servicer know your situation immediately.
3. A HUD-approved housing counselorIndependent advice on forbearance, default and foreclosure, often at little or no cost. Use the CFPB’s “Find a housing counselor” tool or call the CFPB at (855) 411-2372.
On the benefit itself, be realistic. TWC sets your weekly amount at your highest-earning quarter of base-period wages divided by 25, up to a weekly cap, and the total at 26 times that weekly amount or 27 percent of your base-period wages, whichever is less. It is also taxable income to the IRS. For many households with a mortgage, unemployment slows the burn. It does not stop it.
Work Out Your Runway
Every decision after this turns on one number: how many months you can keep the house without new income.
- Add up the essentials. Mortgage with taxes and insurance, utilities, food, transport, health cover, minimum payments on other debt.
- Subtract what is still coming in. Unemployment, a partner’s pay, severance spread over the months it covers.
- Divide your usable cash by the gap. That is your runway in months.
An example with round numbers: essentials of $4,500 a month, $2,900 still coming in, a gap of $1,600. With $12,000 in savings, that is seven and a half months. Your figures will differ. The method does not.
Now set that number against two others: how long people in your field are honestly taking to get hired, and how long a sale takes. Our Texas selling timeline guide puts a traditional listed sale in Texas at roughly three to four months from decision to funds. A runway of four months is not four months to think about it.
The Clock: How Long You Really Have in Texas
Foreclosure does not start the day you miss a payment. Federal mortgage servicing rules and the Texas Property Code set a sequence, and knowing it takes most of the panic out of the decision.
- Day 1. A payment is missed. Your loan documents set the grace period and the late fee.
- By day 36. The servicer must make a good-faith effort to reach you in live contact about the missed payment (12 CFR §1024.39).
- By day 45. The servicer must send written notice that includes information about help that may be available.
- After day 120. The earliest a servicer may make the first foreclosure notice or filing (12 CFR §1024.41(f)).
- Then Texas law. On a residence, the servicer must give at least 20 days to cure the default before it can give notice of sale, and at least 21 days’ notice of the sale itself. Sales happen only on the first Tuesday of a month (Property Code §51.002).
Put together, an auction rarely comes sooner than about five months after the first missed payment. But most Texas mortgage foreclosures do not go through a full court case, so once the notices start there is little to slow them down. The detail is in when it is too late to stop a foreclosure in Texas.
Notice what those 120 days line up with: the three to four months a listed sale takes. A homeowner who waits until day 90 to call an agent is racing the notice of sale from the first showing.
One more reason not to let it run. If a foreclosure sale brings less than you owe, Texas allows the lender to sue for the difference for up to two years afterwards (Property Code §51.003), with credit for the home’s fair market value. Selling on your own terms closes that door.
Stay, Pause or Sell: Your Options Compared
| Option | What it does | Fits when | Watch for |
|---|---|---|---|
| Forbearance | Pauses or reduces payments for a set period | The gap is short and you expect to be working again soon | It is not forgiveness. The CFPB is clear that skipped amounts are still owed. Ask how repayment works before agreeing |
| Repayment plan or loan modification | Spreads the arrears out or changes the loan terms | You have income again but cannot catch up in one go | Servicers generally want to see income, so it is hard to get while unemployed |
| List with an agent | A full-market sale | You are current, have several months of runway and the house shows well | Commissions, repairs, showings, and a contract that can fall through |
| Sell to a cash buyer | A fast, as-is sale on a date you choose | The runway is short, the house needs work, or you need certainty | A lower price than a top-of-market listing. Compare what you would net, not the headline number |
| Rent the house out | Keeps the house while a tenant covers the payment | Market rent clearly exceeds your full payment and you can live somewhere cheaper | You become a landlord with no cash cushion for vacancies or repairs |
To compare the two sale routes fairly, put the costs side by side. Our guide to the cost of selling a house in Texas itemizes what comes out of a listed sale, and selling a house with a mortgage explains how the payoff and any arrears are handled at closing.
When Selling Is the Right Call
Selling is not failure. For some households it is the move that protects everything else. It tends to be the right call when several of these are true:
- Your runway is under about four months and nothing is close on the job front.
- The next job is likely to be in another city anyway. See selling a house fast when relocating.
- The payment was already a stretch on your old salary.
- The house needs repairs you cannot fund now, which limits who can buy it later. See selling a house that needs repairs.
- You have real equity, and every month of late fees and default costs eats into it.
And it is usually the wrong call when your severance and savings cover six months or more, a second income handles the essentials, or you owe more than the house is worth. In that last case a sale will not clear the loan without the lender’s agreement, so talk to the servicer and a housing counselor first.
Three Protections Most People Miss
Your homestead is shielded from most creditorsTexas Property Code §41.001 exempts a homestead from seizure for creditors’ claims, with listed exceptions that include the purchase-money mortgage, property taxes and home equity loans. A credit card company cannot force the sale of your home. Your mortgage lender and the tax office can, which tells you which bills actually put the house at risk.
Sale proceeds are protected for six monthsIf you sell your homestead, the same statute protects the proceeds from seizure by creditors for six months after the sale. That gives you room to rent, regroup or buy something smaller.
A tax break for unemployed sellersSellers who owned and lived in a home for two of the last five years can exclude up to $250,000 of gain, or $500,000 filing jointly. Short of two years, IRS Publication 523 lists becoming eligible for unemployment compensation among the events that can qualify you for a partial exclusion, prorated by how long you lived there.
How to Sell Without Wrecking the Next Chapter
- Stay current while you decide, if you can A seller who has not missed a payment has every option open and nothing extra coming out at closing.
- Find out what you owe Ask your servicer for a payoff figure, and add any second lien or HOA balance.
- Get your number both ways An agent’s net sheet and a written cash offer. Both are free, and neither obliges you to anything.
- Line up where you are going first Landlords and lenders ask for proof of income, and that is easier to show before your last pay stubs go stale.
- Pick a closing date that fits the move Not the buyer’s convenience. A cash sale can close in as little as 7–14 days or later if you need the time.
- Keep the paperwork Your closing statement and any Form 1099-S go in the tax file.

A written cash offer costs nothing and commits you to nothing. If you own a home between San Antonio and Austin, including New Braunfels, we will give you one within 24 hours so you can weigh it against listing with a clear head. If keeping the house is the better move, we will tell you so.
Quick FAQs
Should I sell my house if I lost my job?
Not automatically. First file for unemployment and call your mortgage servicer, then work out how many months your savings will cover the shortfall. If that runway is shorter than a realistic job search plus the three to four months a listed sale takes, and you have equity, selling while you are still current is usually the stronger position. If the gap is short and temporary, forbearance may be enough.
How many mortgage payments can I miss before foreclosure in Texas?
Federal rules bar a mortgage servicer from making the first foreclosure notice or filing until the loan is more than 120 days delinquent. Texas law then requires at least 20 days to cure the default on a residence and at least 21 days notice of the sale, and sales are held only on the first Tuesday of a month. In practice that puts an auction about five months or more after the first missed payment.
Can I sell my house if I am already behind on the mortgage?
Yes. You can sell at any point before the foreclosure sale. The title company orders a payoff from your servicer, and the missed payments, late fees and any foreclosure costs are paid from your proceeds at closing along with the loan balance. The sooner you sell, the less of your equity those charges consume.
Does mortgage forbearance erase the payments I skip?
No. The Consumer Financial Protection Bureau is explicit that forbearance does not erase or reduce what you owe. It pauses or lowers payments for a set time, and the missed amount has to be repaid later, whether in a lump sum, over a repayment period or at the end of the loan. Ask the servicer exactly how repayment will work before you agree.
Will I owe taxes if I sell my house after losing my job?
Often not. If you owned and lived in the home for at least two of the last five years, you can exclude up to $250,000 of gain, or $500,000 for a married couple filing jointly. If you fall short of two years, IRS Publication 523 lists becoming eligible for unemployment compensation as an event that can qualify you for a partial exclusion. Confirm your own situation with a tax professional.
Can creditors take my house in Texas if I cannot pay my bills?
Generally not unsecured creditors. Texas Property Code Section 41.001 exempts a homestead from seizure for the claims of creditors, except for specific debts such as the purchase-money mortgage, property taxes and home equity loans. A credit card company cannot force the sale of your homestead. Your mortgage lender and the taxing authorities can.
